lumeactivations.com is run by lumé.

In these Terms, “we”, “us” and “our” mean lumé. “You” means anyone who visits or uses the site, and any business you act for.

What these Terms cover

These Terms cover your use of lumeactivations.com and any page that links to them (the “site”).

By using the site, you agree to these Terms. If you don’t agree, please don’t use the site.

We serve clinics in the US. If you use the site from somewhere else, you’re responsible for following your local laws.

Our services are covered by a signed agreement

The site describes our reactivation campaigns. It is not an offer or a contract.

Every campaign we run is governed by a written agreement signed by the clinic and lumé. If that agreement and these Terms ever disagree, the signed agreement wins.

Our guarantee applies only as written in a clinic’s signed agreement.

Results and testimonials

The results on the site are real results from specific clinics. They are not promised, and every database is different.

The clinic owners featured gave us permission to share their names, photos, words and results.

The opening story uses made-up names, messages and figures to show how a campaign works.

Applying through the site

Sending the “See if you qualify” form does not mean your clinic is accepted. We choose the clinics we work with.

Please give us accurate information when you apply.

We may contact you by phone, text or email about your application. You can opt out of our texts at any time by replying STOP.

Our Privacy Policy explains how we handle the information you send us.

Using the site

You must be at least 18 to use the site.

Please don’t:

• copy, scrape or collect content or data from the site with bots or scripts, or build a database from it
• try to get around, disable or interfere with the site’s security or features
• upload viruses or other harmful code
• impersonate anyone or give false information
• use the site to break the law, or to harass or harm anyone
• frame the site or present it as your own

Our content and brand

The site’s text, design, graphics, video and code, and the lumé name and logo, belong to us or are used under license.

You may view the site, and print or save pages for your own business use. Anything else needs our written permission: ask at support@lumeactivations.com.

Clinic names, photos and videos belong to their owners and appear with their permission.

Other product names and logos on the site, such as booking and CRM software, belong to their owners. Showing them doesn’t mean those companies endorse or partner with lumé.

Other sites and services

The site links to and embeds other services, such as our social media pages and video players. We don’t control them and aren’t responsible for their content. Their own terms and privacy policies apply.

Our Privacy Policy and Cookie Policy explain the analytics tools the site uses.

Feedback

If you send us ideas or suggestions, we may use them without owing you anything.

Changes to the site

We may change, pause or remove any part of the site at any time.

The site may sometimes be unavailable or contain mistakes. We may correct them without notice.

No warranties

The site is provided “as is” and “as available”.

To the fullest extent the law allows, we make no promises about the site, including that it will be accurate, complete, uninterrupted or error free.

Limits on our liability

To the fullest extent the law allows, lumé and its owners, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site.

Our total liability for any claim about the site is limited to $100.

Some places don’t allow these limits, so they may not all apply to you.

This section covers the site only. Liability for a campaign is set by the clinic’s signed agreement.

Indemnity

If you misuse the site or break these Terms and that leads to a claim against us, you agree to cover our resulting losses and reasonable legal costs.

Ending access

We may suspend or block anyone’s access to the site if we believe they have broken these Terms or the law.

Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules.

If a dispute comes up, contact us first. We’ll both try to resolve it informally for at least 30 days before either of us takes formal action.

Any formal claim will be brought only in the state or federal courts located in Wyoming, and you and we agree to their jurisdiction.

Electronic communications

When you use the site, fill in a form or email us, you’re communicating with us electronically.

You agree that notices and messages we send electronically meet any legal requirement to be in writing.

Changes to these Terms

We may update these Terms. The date at the top shows when they last changed.

If you keep using the site after an update, the new Terms apply.

General

These Terms are the whole agreement between you and us about the site. A clinic’s signed agreement covers our services.

If part of these Terms can’t be enforced, the rest still applies.

If we don’t enforce a right straight away, we haven’t given it up.
